The Solicitors who work on your case charge an hourly rate. They will always give an indication of the timescale involved at the outset, and should the anticipated workload either increase or decrease, will inform you.

There are a number of ways which you may fund your professional negligence claim. These include:

Legal Expenses Insurance
We advise that you check your household and motor insurance policies and credit card policies in order to confirm whether they cover you for legal costs in relation to your prospective claim. If you are a member of a Trade Union then please also check with them. If you are unsure of the terms you should be looking for on the policy, do contact us and we can advise you further.

Conditional Fee Agreement (No win no fee)
You may be familiar with this type of agreement, it sometimes known as a “no win no fee” agreement. The agreement is between you and us as your acting solicitors.

In the event that your claim is unsuccessful you will not have to pay any of our costs. You might be responsible for some other expenses but we will discuss this with you in detail at the start of your case to ensure that you are happy with the arrangements.

Private Funding Arrangement
This involves you paying us for the work we conduct on an hourly basis, whatever the outcome of your claim. The hourly rate charged depends on the level of seniority of the member of staff dealing with your claim. You will be sent interim accounts regularly and you will be expected to place us in funds as we conduct the work.

To discuss your claim, and also your funding options, contact Catherine Preece on 01332 225 225 or email catherine.preece@smithpartnership.co.uk.
